These terms apply when you use liquorlibrary.co.nz or buy from us online. Please read them before you order. Nothing in these terms affects your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
1. General
1.1 Definitions
- Customer, you: anyone who buys products on this website, including anyone ordering under your account, and anyone browsing the website.
- We, us, Liquor Library: Liquor Library Ltd.
- Account: the email address and password you use to sign in to this website.
- Products: the products for sale on this website.
- GST: goods and services tax under the Goods and Services Tax Act 1985.
- Intellectual property: all intellectual property rights of any kind, including patents, designs, trade marks and copyright, whether registered or not.
1.2 Accepting these terms
By using this website you confirm that you have read, understood and accepted these terms and agree to be bound by them. An order placed on this website is an offer to buy, which we can accept without contacting you again.
1.3 Which document wins
These terms take priority over any other document that claims to have contractual effect, including our other store policies.
1.4 Accounts
We may refuse to open an account for anyone, for any reason. You are responsible for every order placed under your account, and you must keep your sign-in details safe and private.
1.5 Accepting and cancelling orders
We decide whether an order placed on this website is accepted and fulfilled, and we may cancel an order for any reason. If we cancel your order, we will make reasonable efforts to tell you, and you will receive a refund of the value of the order.
1.6 Suspending accounts
We may suspend or end any customer's ability to buy through this website, for any reason.
1.7 Security
We use reasonable endeavours to stop unauthorised access to this website. We are not liable for any direct or indirect loss if a third party gains unauthorised access, unless we, our employees or our agents acted negligently or fraudulently.
1.8 Website content
We work to keep the information on this website free from errors, but we do not warrant that it is accurate, adequate or complete, and we are not liable for any error or omission in it. We may change the information on this website at any time without notice.
1.9 Using this website
You agree not to use this website for any unlawful purpose or any purpose these terms prohibit. You may download information from this website for your own personal use, but neither the website nor anything on it may be altered, copied, sent or distributed without our written consent. You agree not to interfere with anyone else's use of this website, or damage its operation or our systems, by a virus, corrupted file, other software or otherwise.
2. Prices
2.1 Pricing
You pay the price shown when you place your order, unless we tell you that the price shown was an error. Apart from errors, we do not adjust the price if it goes up or down between your order and delivery.
2.2 Currency and GST
All prices are in New Zealand dollars and include GST.
2.3 Delivery charge
On top of the price of the products, you pay a delivery charge. It is worked out at checkout and shown before you pay. We may change our delivery charges at any time.
For orders over 20 kg (one product or the whole order), we may adjust the delivery charge to reflect the actual cost. If we do, we will contact you before delivery to confirm you accept the new charge, and we will not deliver the order until you do. We are not liable for any delay this causes.
2.4 Changes to an order
If you ask to change an order and we agree, the price will be adjusted to match and shown on your invoice.
2.5 Credit limits
We may set credit limits for individual customers.
3. Availability, range, deals and quantities
3.1 Availability
We make every effort to fill every order, but we are not liable to anyone if we cannot, or decide not to, supply a product for any reason.
We may limit the quantities that can be ordered or delivered. If we reduce your order, we will adjust the price to match. We may delay dispatching orders larger than normal household quantities while we check stock.
3.2 Range
We may limit the range of products available online.
3.3 Deals
Deals are available while stocks last. We do not take back orders for deals that have sold out.
3.4 Seasonal products
We are not liable if we cannot supply a product because it is seasonal.
3.5 Substitutions
If we cannot supply a product you ordered, we will contact you before sending a similar product in its place. If you agree to a substitute of equal or higher value, you pay the price of the product you originally ordered. If you agree to a substitute of lower value, you pay the lower price. If you do not want a substitute, we will refund that product. We may refuse to substitute any product.
4. Payment
4.1 How to pay
You pay for your order at checkout, using one of the payment methods shown there.
4.2 Declined payments
If your payment is declined, we will not send the order and will contact you to arrange another way to pay. We may refuse a particular payment method from any customer for any reason.
4.3 Corrections
If you are charged the wrong amount for a product, we will refund you, or you will pay us, the difference.
4.4 Debt collection
If you fail to pay for an order, you are liable for all costs of collecting the debt.
4.5 Changes to payment
We may change the ways you can pay at any time, and will tell you before a change takes effect.
5. Changing or cancelling an order
5.1 Changes by you
You can change or cancel an order until we start packing it, by calling 09 623 1903 or emailing info@liquorlibrary.co.nz. Once the courier has collected your order, it can no longer be changed or cancelled.
5.2 Cancelling after packing
If you cancel an order after it has been packed, a $10 cancellation fee applies.
5.3 Cancellation by us
We may cancel all or part of an order, including an order we have accepted, without liability to you, if:
- the products are not available;
- there is an error in the price or description of a product on this website; or
- we reasonably believe the order breaches these terms.
If we cancel an order, we will try to give you reasonable notice and will not charge you for the cancelled order.
6. Delivery
6.1 Where we deliver
We deliver anywhere in New Zealand, across the North and South Islands. Our delivery policy sets out costs, times and tracking.
6.2 18+ and photo ID
You must show current photo ID with your full name and date of birth to the person delivering your order. We will not hand over alcohol to anyone under 18, or to anyone who cannot show ID proving they are 18 or over.
6.3 Delivery times
We use reasonable endeavours to deliver to the address you give us within a reasonable time. Please tell us straight away if your delivery address changes.
6.4 When delivery is complete
Delivery is complete when your order reaches the address you gave us. We arrange delivery unless you arrange otherwise with us.
6.5 Damage or shortages
Tell us about any damage in transit or missing products no later than three days after your order arrives. See our returns policy.
6.6 Our liability for delivery
If we fail to deliver or delay all or part of your order, or you suffer a loss in relation to delivery, and this is within our control, our liability is limited to the cost of replacing the order or the affected part of it, as we decide.
7. Risk and ownership
Risk in the products passes to you on delivery. The products become yours once you have paid for them in full and they have been delivered.
8. Warranties
Subject to the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, all other terms, warranties, guarantees and conditions, whether implied by law, custom or otherwise, including merchantability and fitness for a particular purpose, are excluded to the fullest extent the law allows.
You do not rely on any statement made by us or on our behalf other than these terms. You will use the products only for suitable purposes and take all necessary care in handling and using them.
We guarantee that our products:
- are of acceptable quality, having regard to their nature, price, what we have said about them, and any statements on their packaging or labels;
- are reasonably fit for the purpose we say they are for; and
- match their description.
9. Liability
Subject to your rights under law, including the Consumer Guarantees Act 1993, we are not liable in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from a defect in a product or any other breach of our obligations under these terms.
We are not liable for any consequential, indirect or special loss of any kind arising from your use of, or inability to use, this website, or from the delivery or non-delivery of any products.
10. Alcohol
10.1 Age
By ordering alcohol, you confirm that you are 18 or over, legally allowed to buy it, and not under the influence of alcohol when you place the order.
10.2 Using your account
You must not let anyone use your account to buy alcohol unless they meet clause 10.1.
10.3 Checking your age
We may contact you to check your age. If we are not satisfied that you meet clause 10.1, we may cancel the order.
10.4 Restricted days
Orders containing alcohol placed on Good Friday, Easter Sunday, Christmas Day or before 1pm on Anzac Day are not accepted at checkout. They are treated as accepted at 12.05am the next day.
11. Intellectual property
All intellectual property in this website and its content belongs to Liquor Library, our licensors and the providers of other products and services available through this website, and is protected by New Zealand and international law. Nothing in these terms gives you a licence to any of it.
12. Events outside our control
We are excused from performing these terms to the extent we are prevented by events beyond our reasonable control. These include fire, accident, natural disaster, acts of government, strikes or labour shortages, shortages of products, delays in transit, and power or communications failures.
13. Links to other websites
Links to other websites are provided for convenience only and do not mean we endorse or have checked them. We do not monitor other websites and are not responsible for their content.
You must not link to this website without our written permission, or frame any part of it with advertising or other revenue-generating material. If you do link to it, you do so at your own risk and are responsible for any loss we suffer as a result.
14. Changes to these terms
We may change these terms at any time without notice, so please check them from time to time. If you keep using this website after the terms change, you accept the changes.
15. Governing law
New Zealand law governs these terms and your use of this website.
